Workshop Terms & Conditions

These Terms and Conditions apply to all painting workshops, classes and related creative activities provided by Krystyna Krasowska-Cicha trading as CichaArt (“CichaArt”, “I”, “me” or “my”).

By booking a workshop or attending a workshop, you agree to these Terms and Conditions.

1. Booking and Confirmation

Workshop places are limited and are normally allocated on a first-come, first-served basis unless otherwise stated.

A booking is confirmed once:

the booking has been successfully completed; and
the required workshop fee has been paid.

You will receive confirmation of your booking using the contact details provided at the time of booking.

Please check your booking confirmation carefully and contact me as soon as possible if any information is incorrect.

CichaArt reserves the right to decline a booking where there is a reasonable business, safety or practical reason for doing so.

2. Workshop Fees and Payment

All workshop prices are stated in euro (€) and include the items specifically described in the workshop listing.

Unless otherwise stated, payment in full is required at the time of booking.

Payments made through the CichaArt website may be processed through third-party payment providers, including Stripe and PayPal.

CichaArt will make reasonable efforts to ensure that workshop prices and descriptions are accurate. If an obvious pricing or description error occurs, I reserve the right to correct it and, where appropriate, offer you the option to cancel the booking and receive a refund.

3. Participant Cancellation and Transfer

Because workshop places are limited, cancelling a booking at short notice may prevent another person from taking the place.

If you need to cancel, please contact CichaArt as soon as possible.

Transfer of a booking

You may request to transfer your place to another person, subject to:

prior written notice to CichaArt;
the replacement participant meeting any relevant age or workshop requirements; and
CichaArt confirming the transfer.

Where possible, transfer requests should be made at least 21 days before the workshop.

A transfer may not be possible at shorter notice, particularly where materials, venue arrangements or workshop administration have already been finalised.

Cancellation by a participant

If you do not attend a workshop and have not arranged an approved transfer, CichaArt will normally not be able to provide a refund or credit.

Where a cancellation is made sufficiently in advance and the workshop place can be successfully filled from a waiting list or otherwise rebooked, CichaArt may, at its discretion, offer a refund or credit.

Nothing in this section affects any statutory rights you may have under applicable Irish or EU consumer law.

4. Cancellation or Changes by CichaArt

CichaArt reserves the right to cancel, postpone or reschedule a workshop where reasonably necessary, including because of:

insufficient bookings;
illness or unexpected personal circumstances;
venue problems;
health and safety concerns;
severe weather;
government restrictions;
failure of essential facilities or utilities; or
circumstances outside my reasonable control.

If CichaArt cancels a workshop, you will normally be offered either:

a place on a rescheduled or alternative workshop; or
a refund of the workshop fee paid to CichaArt.

If a workshop has to be changed significantly, I will communicate the change as soon as reasonably possible.

CichaArt is not normally responsible for additional costs you may incur in connection with a workshop, such as travel, accommodation or other arrangements, except where liability cannot lawfully be excluded.

5. Workshop Content and Changes

Workshop descriptions provide an indication of the planned content and learning experience.

I may make reasonable changes to:

demonstrations;
exercises;
timings;
painting subjects;
materials;
teaching methods; or
activities,

where necessary to suit the group, venue, available materials, weather or other practical circumstances.

I will make reasonable efforts to provide the workshop experience described at the time of booking.

6. Health, Safety and Materials

Painting workshops may involve materials and equipment including oil paints, mediums, solvents, brushes, palette knives, easels and other art materials.

Participants must:

follow reasonable safety instructions;
use materials and equipment responsibly;
follow any instructions relating to ventilation, cleaning and storage;
immediately report an accident, injury, spill or safety concern;
ask before using unfamiliar materials or equipment.

If you have an allergy or sensitivity to any material that may be used during the workshop, please inform CichaArt before attending so that reasonable safety arrangements can be considered.

You should only provide information that is relevant to safe participation. CichaArt does not require unnecessary medical information.

Participants are responsible for following safety instructions and for taking reasonable care of themselves and others.

7. Personal Responsibility

You participate in a workshop at your own responsibility and should take reasonable care during the session.

Please wear suitable clothing and footwear. Oil paint, mediums and other art materials may stain clothing and personal belongings.

CichaArt will provide reasonable instructions and take reasonable steps to maintain a safe workshop environment, but participants must also act responsibly and follow safety guidance.

8. Personal Belongings and Artwork

Participants are responsible for their personal belongings, equipment and completed artwork while attending a workshop.

CichaArt is not responsible for loss or damage to personal property except where such liability cannot lawfully be excluded.

Participants are responsible for transporting their completed artwork home unless another arrangement has been agreed.

9. Behaviour and Right to Refuse Participation

All participants are expected to behave respectfully towards other participants, the tutor, venue staff and members of the public.

CichaArt may ask a participant to leave a workshop where their behaviour is:

abusive or threatening;
seriously disruptive;
discriminatory or harassing;
creating a safety risk; or
otherwise preventing the workshop from being conducted safely and appropriately.

Where a participant is asked to leave because of their behaviour, a refund will not normally be provided, subject to any rights that cannot lawfully be excluded.

10. Photography and Recording

Photography or short video recordings may sometimes take place during workshops or events for purposes such as documenting the workshop or promoting future CichaArt activities.

I will make reasonable efforts to inform participants when photography or filming is taking place.

If you do not wish to appear in promotional photographs or recordings, please tell me before the workshop or event. I will take reasonable steps to respect your request.

If I intend to use an identifiable participant’s image for promotional purposes where consent is required, I will seek appropriate permission.

Participants must not photograph, film or record another participant in a way that identifies them without that person’s permission.

11. Workshop Materials and Intellectual Property

Teaching materials, demonstrations, written information, exercises, photographs, presentation materials and original teaching content provided by CichaArt remain the intellectual property of Krystyna Krasowska-Cicha unless otherwise stated.

They are provided for the participant’s personal learning and enjoyment.

You must not reproduce, sell, distribute, publish or commercially exploit CichaArt’s teaching materials or demonstrations without prior written permission.

You are free to photograph and share photographs of your own completed artwork.

12. Workshop Artwork

Unless otherwise agreed, participants retain ownership of artwork they create during a CichaArt workshop.

CichaArt may photograph completed artwork for workshop documentation, portfolio purposes or promotion.

Where a photograph could reasonably identify a participant and is intended for promotional use, CichaArt will seek appropriate permission where required.

13. Third-Party Venues

Some workshops may take place at venues operated or managed by third parties.

Participants must comply with the reasonable rules and safety requirements of the venue.

CichaArt is not responsible for matters arising solely from the actions, omissions or facilities of a third-party venue, except where liability cannot lawfully be excluded.

14. Circumstances Outside Our Reasonable Control

CichaArt will not be responsible for delay, cancellation or changes caused by circumstances outside reasonable control, including severe weather, illness, government restrictions, public health emergencies, venue closure, utility failure or other unforeseen circumstances.

Where such circumstances affect a workshop, CichaArt will communicate with participants and, where reasonably possible, offer an alternative date, transfer or refund as appropriate.

15. Liability

CichaArt will take reasonable care in providing workshops and related services.

Nothing in these Terms and Conditions excludes or limits any liability that cannot lawfully be excluded or limited under Irish law.

To the extent permitted by law, CichaArt is not responsible for loss or damage arising from a participant’s failure to follow reasonable safety instructions, misuse of materials or equipment, or negligent or unsafe behaviour.

Nothing in these Terms and Conditions affects your statutory consumer rights.

16. Consumer Rights

Nothing in these Terms and Conditions is intended to exclude, restrict or limit any rights or remedies you have under applicable Irish or EU consumer protection law.

If any provision of these Terms and Conditions is found to be unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

17. Privacy

Personal information relating to workshop bookings, payments, communications, surveys and workshop administration is handled in accordance with the CichaArt Privacy Policy.

The Privacy Policy explains what information CichaArt collects, why it is used, who it may be shared with and your rights under applicable data protection law.

18. Governing Law

These Terms and Conditions are governed by Irish law.

Any disputes will be subject to the jurisdiction of the Irish courts, subject to any mandatory consumer protection rights that apply to you.

19. Changes to These Terms

CichaArt may update these Terms and Conditions from time to time.

The version applicable to your booking will normally be the version in force at the time you make your booking, unless a change is required by law.

The latest version will be published on the CichaArt website.
